Terms and Conditions for Web Hosting Service

This agreement is between UCLA Humanities Technology (HumTech) and users of the Web Hosting Services (“Users”).
Acceptance of Terms: By using the Services, the User agrees to the terms outlined in this agreement.
Service Provision: The HumTech will use reasonable efforts to ensure that the Services are available to the Users in accordance with the Service Level Agreement (SLA).
User Obligations: Users are responsible for all activities that occur under their account. Users agree to comply with all applicable laws and regulations in their use of the Services including UCLA’s information security governance policies (https://ociso.ucla.edu/governance ) as well as the Family Educational Rights and Privacy Act (FERPA). Users are also required to comply with Reclaim Hosting’s terms and conditions: https://www.reclaimhosting.com/terms-of-service/
Prohibited Use: Users may not use the Services for any illegal or unauthorized purpose. This includes, but is not limited to, activities related to hacking, phishing, spamming, or any form of harassment. Users may not use the Services for any commercial or for-profit purposes.
Privacy: HumTech will handle User data in accordance with UCLA’s Privacy Policies: https://privacy.ucla.edu/policies/ .
Termination: HumTech reserves the right to suspend or terminate the Services to a User without notice if the User violates these Terms and Conditions.
Length of Service: Humanities faculty, staff, and graduate students will be provisioned the Services for a period of 12 months, after which renewal is possible but not guaranteed. Renewal is subject to users confirming on an annual basis that the Services are still being used. Undergraduate students must be enrolled in an active course and have instructor approval prior to applying. Undergraduate students will be provisioned for a period of 12 months with no option for renewal.
Changes to Terms: HumTech reserves the right to modify these Terms and Conditions at any time. HumTech will notify Users of any significant changes.
Limitation of Liability: HumTech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from the use of the Services.
Governing Law: These Terms and Conditions are governed by the laws of the State of California.
By using the Services, the User agrees to abide by these Terms and Conditions.
